Abstract

Posterity waqf is an important inheritance for Muslims. Several aspects of posterity waqf have been scrutinized particularly in terms of its governance. Posterity waqf has long been practiced in Terengganu, as early as prior to the national independence. The enforcement of posterity waqf is enshrined in Waqf Enactment (Terengganu State) 2016. Accordingly, the issues pertaining to the implementation of posterity waqf were addressed among others first, the case of posterity without heirs and the role of the authorities to manage the status of this kind of posterity waqf. Secondly, the issue of incomprehensible waqf vows and thirdly, the problem of low land waqf yield and its contributing factors. This issue had also captured the attention of the National Audit Department in 2014. The objective of this study is to scrutinize these three issues. This study is conducted by employing the qualitative research design with the approach of exploratory method. Data were collected by the interview process of several MAIDAM officers as well as from the official sources or records from the department. This study reveals the status of posterity in which 3/12 are active, while 9/12 are still under tracing process by MAIDAM. For the waqf vows, 6/12 of vows were written in roman script, while another 6/12 were written in jawi (Arabic letter) script. One of the waqf vows reviewed and required approval by the Fatwa Committee of Terengganu State is the posterity waqf of Haji Abdullah Bin Mohamad Al-Fatani. Meanwhile, the yield of land waqf is found low and unfavourable. Nonetheless, the beneficiaries still receive the benefit of the land waqf return even at low rates. This is a consequence of the development of the existing posterity land waqf is not in commercial form. Nevertheless, MAIDAM is working towards developing the land waqf in collaboration with the developers and related bodies. In conclusion, if the posterity waqf can be optimally empowered, then this inheritance would act as the catalyst for the socio-economic development of Muslims in this country especially in the state of Terengganu.
